The general question I ask myself before making a big decision is: “does the benefit of an endeavor outweigh the pain of a loss?” This was the question I asked before deciding to go to law school, as I weighed my hope for a more fulfilling career as a lawyer against the loss of a budding career at Meta; the question I asked before attending college in the States and leaving behind my family and all things familiar in Brazil; the question I ask before eating oysters, a delicacy I have a history of food poisoning with. Answering this question isn’t really one of rational calculus, it’s a verdict that my instinct renders after it roughly weighs my optimism against my fear. And, at the end of every decision, one sentiment is greater than the other. Thus, to the extent that my decision-making involves the weighing of potential gains and losses, I identify with Kahneman’s and Tversky’s loss aversion theory. However, I don’t think their simple proposition on the asymmetry between the fear of losses and the anticipation of gains completely explains my decision-making process behind my career aspirations. Let me begin by elaborating on the anatomy of my fear.

My Indifference Breeds Fear

The sources of my fear are pretty conventional but, generally, they are (1) the prospect of failure and (2) my lack of confidence in certain areas. For example, I fear that starting my own law practice will not be a lasting venture and I am not confident that I have the experience nor competence to run one right out of law school. I find such driving forces of fear to be inevitable and natural for me so eradicating them isn’t feasible. Instead, I think my response has been to rely on my passions to outweigh my fears.

My Fear’s Amplifier

The sources of my fear are pretty conventional but, generally, they are (1) the prospect of failure and (2) my lack of confidence in certain areas. I find such sources to be impossible to outroot so, instead, my response has been to mitigate their strength by turning to my passion and empathy. For example, if my cold call is regarding a topic I feel passionately about, it’s quite easy for me to dismiss the eyes of my colleagues and professor because my focus on the topic trumps my concern for other things.

In other words, fear’s grip over my decisions is only as strong as my indifference allows it to be. Take my cold call experience as an example. I understand how trivial the consequences of bombing a cold call are – recite the wrong answer and face the momentary judgment of a handful of your classmates. The stakes are miniscule but I find myself getting flustered when I struggle to retrieve the answer to my professors’ questions. However, if the cold call is regarding a topic I feel passionately about, it’s quite easy for me to dismiss the eyes of my colleagues and professor. My focus on the topic trumps my concern for other things. In sum, the greater the indifference I hold towards a subject, the greater sway my fear has over my decisions.

My antidote to fear is thus “less indifference and more care.” Unfortunately, I have a deeply embedded neutralization mechanism that I frequently use to cope with difficult times and to detach myself from the attendant difficult emotions. When bad things happen, my knee-jerk reaction is to “see the other side of it.” I tell myself there are justified and fair reasons for why a bad thing happened and why it happening is not a big deal. I recycle through variations of “it was inevitable that things turned out this way”, “it’s not that bad,” or “at least I learn something from this.” This was how I have coped with heartbreak, embarrassments, and a few traumatic events over my lifetime.

This detachment ironically comes from my attempts at empathy. When bad things happen, my knee-jerk reaction is to “see the other side of it.” I tell myself there are justified and fair reasons for why that bad thing happened and why it happening is not a big deal. This was how I coped with heartbreak, embarrassments, and a few traumatic events. As an example, I coped with my deportation from the States when my work visa was denied an extension with this detachment mechanism. Denials for visa extension applications had increased during the Trump administration and I was not fortunate enough to beat the odds. So, in December 2018, my life in the States appeared to end abruptly. My company informed me that I had no legal basis to remain in the U.S. and they did not know if I would be able to return. So I packed and stored my stuff, shared heartfelt good-byes, and left for Brazil, all within one week. I coped with this by telling myself I had no right to be angry because I was not a U.S. citizen and that my ability to reside in the U.S. was possible only with the government’s reserved right to terminate my visa. Without this limited visa, I would never have had the opportunity to build a life in the U.S. so I instead reminded myself to be grateful that I had remained in the States for as long as I did. And, lastly, I assured myself that I would make do somehow in Brazil. All these self-messages regarding my deportation enabled me to neutralize any negative sentiment for it. Though this coping mechanism does provide me a balanced view, keeping me from getting too hot or cold, I realized that it also engenders indifference. My reaction to the January 6 attack is one example. My friends called it a significant threat to democracy but I didn’t find it that threatening, especially compared to Operation Car Wash in Brazil where several Brazilian government officials accepted bribes in exchange for favors for several businesses.

Sometimes, this mechanism of neutralization leads to seemingly courageous acts, like the time I rushed to immobilize a violent man beating another man until the police arrived – my fear of “what I get hurt” was neutralized by my reaction of “this other dude is going to get really hurt if I don’t do anything.” Other times, this neutralization results in indifference and has me sitting idly under the weight of fear, like the time I didn’t object to my coworkers’ derogatory remarks about another coworker – I thought “maybe the coworker did something really bad,” so I couldn’t muster enough care (and indignation) to overcome my background fear of the mob’s reactive backlash and anger. Though this detachment mechanism has been beneficial at times, I know it to also engender broad indifference.

If my indifference often stifles my capacity to care enough, perhaps I need to rely more on confidence as a tool to combat doubt and fear. However, I have found maintaining confidence to be over-dependent on positive self-talk and achievements - it’s very conditional. Empathy and passion have been more durable and less shakable. For instance, not making the game-winning basketball shot for my team shakes my ability to say “I can make game-winning shots” but it doesn’t diminish the sentiment “I need to make this for my team who has clawed its way back from down 20.” Furthermore, though I may be indifferent to many things, I find care to be a more potent source of courage than confidence: the sense of fulfillment and joy I feel when doing something I care about relegates doubt and fear to a corner where I cannot sense them.

So I turn to the few things I do care about to guide my life. My proximity to poverty and violence in São Paulo, Brazil has inculcated in me a sensitivity against unequal access to opportunities and violent crimes. I also care about my parents, who will have to rely on me for financial sustenance. I also deeply enjoy using technology to create things with efficiency and scale. These compasses of passion motivated me to apply to law school with an eye towards legal tech, which I believe can democratize access to legal services while also being a lucrative pursuit.

In my very first year in law school, I let myself get over-consumed by the law school environment that fostered competition for 1L grades. I lost touch with my compasses. This summer, I am reorienting myself back on my original journey by processing the inspiration I salvaged from my first year to plan my next steps. Reading Desmond’s work has been one such inspiration. He had me thinking that there must be something technology can do to reduce the transaction costs for those in poverty when applying for food stamps and disability assistance or accessing affordable housing. There are other problems I’m interested in solving, though, and I am researching the intricacies of these problems over the next couple of months before committing to solving one of them. I may fail but it will be well worth it, simply because I will be working on the very things I care and get excited about.

The stark division shown in the image you linked actually quite resembles the area I live in - the favelas are only a few blocks away from my apartments. I have never seen people actually step on the homeless but the stripping of dignity against the poor, especially through fatal police brutality, was a recurring story during my childhood in Brazil.

Professor Moglen remarked that he “cannot teach us courage” but I think he’s sprinkled a trail of readings and life stories that invite us to feel strongly enough for something in the legal profession to overpower the fears that hold us back. For me, that something lies in my upbringing and work experience. My proximity to poverty and violence in Brazil has led me to staunchly attribute unequal access to opportunities, basic rights, and even common decency for the underprivileged as the root disease to said poverty and violence. Hi Ho Dong! First off, while I have never been to Brazil myself, my mom traveled there for work quite frequently during the earlier stages of her career in the fashion industry. Your reference to Operation Car Wash got me thinking about some of the stories she told me about the levels of poverty in Brazil, and what she referred to as the lack of respect for humanity she encountered during her travels there. The sight of people stepping on homeless kids laying on the street while going from place to place, across the road from luxury housing areas with visible poverty lines such as the one in this famous picture, for example, has stuck with her ever since she first traveled there. She still talks about it now, over a decade since her last trip to Brazil. While I still feel that events such as the attack on the Capitol do present real threats to democracy, I understand your indifference after having been exposed to much more extreme instances of destabilizing behavior. I also struggle to balance wanting to provide myself and my family (someday in the future) with a comfortable life versus aspiring to make a palpable change in the lives of children who otherwise may never have a chance to prosper themselves, and have spoken to Eben about this as well. I appreciate your perspective, and always find reading about what led people toward their desired career balance helpful. Thanks for sharing.

Both morals and the law regulate themselves through value propositions. If I am generous, I gain an elevated sense of self; if I am not generous, I feel shame. If I commit murder, I will be incarcerated; if I don’t commit murder, I will enjoy liberty. The reality, though, is that moral constraints don’t perfectly overlap with legal constraints. The Reign of Fear in Law School

In this heightened age of social media, socially “good” behavior gets rewarded more vigorously in the form of followers from all over the world and socially “bad” behavior gets punished more severely with hate comments from people who would have never dared utter them in person. Even if we assume the frequency of rewards (1 follower) and punishment (1 unfollow) to be equal, loss aversion holds that each unit of punishable behavior hurts more than each unit of rewardable behavior feels good. Social media amplifies this asymmetry by increasing the potential scale of punishments and rewards. One mistake on your part may reverberate through GroupMe? , Instagram, Twitter and – as one professor found - Above the Law and can have unprecedented personal and professional ramifications. This microphone effect of loss aversion doesn’t end there – students feast on negative gossip more than positive talk. Not only is there an infrastructure but also agents that broadcast punishable behavior more fervently than commendable behavior. And so it’s more important that we avoid appearing morally abominable (i.e. disrespectful) rather than appearing morally commendable (i.e. respectful). We were already fear-driven and social media has made us even more so.

Columbia Law School is home to an overwhelming number of law students who aspire to be corporate lawyers. “Corporate lawyers” is really a euphemism for our truer aspirations of cashing in instant six figure cash multiples. A standalone positive motive of money, though, doesn't explain this overpowering tendency. Consider this straightforward hypothetical. If law students were offered the same $215,000 but for starting their own practices, I have no doubt most law students – me included - would accept that hypothetical offer. The differences between a Big Law offer and this hypothetical offer illuminate the true gods behind our decisions. With a guaranteed high salary, we primarily eliminate uncertainty and initial financial inferiority, characteristics that typically accompany starting your own practice. With your own practice, we primarily gain some autonomy to pursue legal issues and clients one finds (presumably) morally meaningful. In conceding that we’d rather do Big Law, as 80% of Columbia law students do, we concede that the loss of certain financial superiority is greater than the gain in autonomy to pursue morally meaningful pursuits. Fear of losing material value beats the reward of pursuing moral value. To be more precise, the gain of guaranteed autonomy, albeit limited since a practitioner is constrained by bills, is not greater than the guaranteed gain of $215,000 in one year. Owning a Lamborghini is generally sexier than owning a medal of honor. It certainly doesn’t help when this guaranteed loss is concurrent with six-figure debt or family members that will depend on you for income.

And law school doesn’t really do much to combat this asymmetry. Professors teach doctrine and precedents and reward those who most quickly understand the underlying rules and reasoning. There is no discussion of morals; though we are encouraged to think about “policy”: should a utilitarian cost benefit analysis guide verdicts? Should we respect the autonomy of individuals when deciding the property rights of organs? An invitation to choose among available policy frameworks is no substitute for the internalization of morals that shape character. Morals are a set of beliefs that drive the heart while policy frameworks are a set of beliefs that drive rationale. Faculties of human behavior are all interlinked – rationale affects the heart and vice versa - so these distinctions may inevitably be blurry.

Is This Dearth Bad For the Legal System?

Not necessarily. Lawyers are incentivized to represent their clients in their best capacity since success in cases translates to personal, material success. Still, the adversarial system doesn’t provide blanket immunity against a dearth of morals. Judges decide which adversarial position is successful and morals, or the lack thereof, guide their decisions. Prosecutors swing for maximum sentences in acquiescence to populist pressures over empathy to all parties. Whether institutional safeguards like the adversarial process overcome these individual cracks of morality in the agents of the law is an open question.

The Solution

Assuming that increasing the internalization of morals is desirable, the solution is either bolstering the gains experienced by possessing morals or heightening the loss in disclaiming morals. This solution needs to be a top-down approach. Law firms and professors control the reward and punishment schemes that aspiring lawyers weigh. But perhaps reversing the asymmetry between fear of losing material worth and the fulfillment of gaining moral worth is insurmountable with today’s institutions and norms.

I think this is a satirical effort to cartoon bullshit reductive materialism by pretending to believe in it. The point appears to be to show that one cannot understand anything, particularly including law school, by imagining it to be nothing but a series of material wins and losses. Obviously if one thought of every occasion on which one speaks in class as either a victory or an injury, learning from one another would cease. If one actually thought that altruism is merely ego gratification, then (in what is presumably intended to be the crowning irony) there would be no need to teach people how to shape their practices in light of their moral requirements, because people wouldn't have any.

But how does this help you to connect with the reader? Proving that bullshit is neither right nor wrong but strictly unconcerned with truth is easy and unsatisfying: readers know already that this is nonsense before the conclusion solemnly so assures them. The valuable central idea here is far more sophisticated than the cartoon. You begin describing the way in which this obviously spurious understanding of human nature is modeled—and, for its captive users, enforced—by the software entity I call the Parasite with the Mind of God: the surveillance-based, engagement-focused "social media" systems. Dropping the coy device of inhabiting the persona rather than standing analytically outside it will enable you to do much more with the insight. That feels to me like the best way forward for the draft.

This is what I meant when I said almost fifteen years ago that Mark Zuckerberg had done more harm to the human race than anyone else his age. Now, when every idiot in the village knows this and is after him, it would be really a good idea for people to know what actually went wrong. Understanding the fundamental problem is more important than holding this particular schmuck (or all of the schmucks) responsible. The real issue is (a) way more serious, (b) utterly harmful, and (c) relatively easy—but way too beneficial to human beings to be politically feasible—to fix than whatever absurd little piece of the puzzle the various regulators and self-promoter lynch mobs are presently on about.

The valuable central idea here is far more sophisticated than the cartoon. You begin describing the way in which this obviously spurious understanding of human nature is modeled—and, for its captive users, enforced—by the software entity I call the Parasite with the Mind of God: the surveillance-based, engagement-focused "social media" systems. Dropping the coy device of inhabiting the persona rather than standing analytically outside it will enable you to do much more with the insight. That feels to me like the best way forward for the draft.

This is what I meant when I said almost fifteen years ago that Mark Zuckerberg had done more harm to the human race than anyone else his age. Now, when every idiot in the village knows this and is after him, it would be really a good idea for people to know what actually went wrong. Understanding the fundamental problem is more important than holding this particular schmuck (or all of the schmucks) responsible. The real issue is (a) way more serious, (b) utterly harmful, and (c) relatively easy—but way too beneficial to human beings to be politically feasible—to fix than whatever absurd little piece of the puzzle the various regulators and self-promoter lynch mobs are presently on about.

A Casual Empiricist’s Opinionated Theory On the Dearth of Morals in Aspiring Lawyers

Prelude on Morals

Both morals and the law regulate themselves through value propositions. If I am generous, I gain an elevated sense of self; if I am not generous, I feel shame. If I commit murder, I will be incarcerated; if I don’t commit murder, I will enjoy liberty. If moral constraints are more restrictive than the law, there is no need for the law since morals will regulate our behavior within the bounds of the law. The reality, though, is that moral constraints don’t perfectly overlap with legal constraints. There are fields of social life that the law does not govern, making morals an important regulator for agent behavior in these areas.

Two Theories

Assuming that a gain-loss framework aptly describes the effectiveness of morals in regulating individual behavior, I rely on Kahneman’s and Tversky’s loss aversion theory to explain the dearth of morals in aspiring lawyers. Simply put, messing up on a cold call hurts more than acing a cold call feels good. There are exceptions to loss aversion theory – people whose enjoyment of a subject overpowers fear of failure – but I reasonably assume this isn’t the genetic composition for most people. In addition, evolution theory explains why we value material characteristics rather than moral ones. Society today has extolled the individual that possesses a vast material worth as the successful mate rather than an individual with vast moral worth.

The Reign of Fear in Law School

In this heightened age of social media, socially “good” behavior gets rewarded more vigorously in the form of followers from all over the world and socially “bad” behavior gets punished more severely with hate comments from people who would have never dared utter them in person. Even if we assume the frequency of rewards (1 follower) and punishment (1 unfollow) to be equal, loss aversion holds that each unit of punishable behavior hurts more than each unit of rewardable behavior feels good. Social media amplifies this asymmetry by increasing the potential scale of punishments and rewards. One mistake on your part may reverberate through GroupMe? , Instagram, Twitter and – as one professor found - Above the Law and can have unprecedented personal and professional ramifications. This microphone effect of loss aversion doesn’t end there – students feast on negative gossip more than positive talk. Not only is there an infrastructure but also agents that broadcast punishable behavior more fervently than commendable behavior. And so it’s more important that we avoid appearing morally abominable (i.e. disrespectful) rather than appearing morally commendable (i.e. respectful). We were already fear-driven and social media has made us even more so.

Columbia Law School is home to an overwhelming number of law students who aspire to be corporate lawyers. “Corporate lawyers” is really a euphemism for our truer aspirations of cashing in instant six figure cash multiples. A standalone positive motive of money, though, doesn't explain this overpowering tendency. Consider this straightforward hypothetical. If law students were offered the same $215,000 but for starting their own practices, I have no doubt most law students – me included - would accept that hypothetical offer. The differences between a Big Law offer and this hypothetical offer illuminate the true gods behind our decisions. With a guaranteed high salary, we primarily eliminate uncertainty and initial financial inferiority, characteristics that typically accompany starting your own practice. With your own practice, we primarily gain some autonomy to pursue legal issues and clients one finds (presumably) morally meaningful. In conceding that we’d rather do Big Law, as 80% of Columbia law students do, we concede that the loss of certain financial superiority is greater than the gain in autonomy to pursue morally meaningful pursuits. Fear of losing material value beats the reward of pursuing moral value. To be more precise, the gain of guaranteed autonomy, albeit limited since a practitioner is constrained by bills, is not greater than the guaranteed gain of $215,000 in one year. Owning a Lamborghini is generally sexier than owning a medal of honor. It certainly doesn’t help when this guaranteed loss is concurrent with six-figure debt or family members that will depend on you for income.

And law school doesn’t really do much to combat this asymmetry. Professors teach doctrine and precedents and reward those who most quickly understand the underlying rules and reasoning. There is no discussion of morals; though we are encouraged to think about “policy”: should a utilitarian cost benefit analysis guide verdicts? Should we respect the autonomy of individuals when deciding the property rights of organs? An invitation to choose among available policy frameworks is no substitute for the internalization of morals that shape character. Morals are a set of beliefs that drive the heart while policy frameworks are a set of beliefs that drive rationale. Faculties of human behavior are all interlinked – rationale affects the heart and vice versa - so these distinctions may inevitably be blurry.

Is This Dearth Bad For the Legal System?

Not necessarily. Lawyers are incentivized to represent their clients in their best capacity since success in cases translates to personal, material success. Still, the adversarial system doesn’t provide blanket immunity against a dearth of morals. Judges decide which adversarial position is successful and morals, or the lack thereof, guide their decisions. Prosecutors swing for maximum sentences in acquiescence to populist pressures over empathy to all parties. Whether institutional safeguards like the adversarial process overcome these individual cracks of morality in the agents of the law is an open question.

The Solution

Assuming that increasing the internalization of morals is desirable, the solution is either bolstering the gains experienced by possessing morals or heightening the loss in disclaiming morals. This solution needs to be a top-down approach. Law firms and professors control the reward and punishment schemes that aspiring lawyers weigh. But perhaps reversing the asymmetry between fear of losing material worth and the fulfillment of gaining moral worth is insurmountable with today’s institutions and norms.
