| Determinism in General
To say that an action is determined is to say that an action “P” was caused by the antecedent conditions “1P” (p-prime). This of course is not ground breaking. Indeed, we admit as much in our everyday lives. For instance, when we hear that a plane has crash landed in the Hudson River we ask “Why?” We know better than to assume that the act of a plane crashing was a completely random event not preceded by any action or condition that could be deemed its cause.

< < | Human beings are not exempt from causal forces. Our physiology is determined by them. Heart disease doesn’t instantiate itself. It is the result of poor diet and/or genetic disposition. Similarly, our actions are determined by whatever antecedent conditions exist. Let us consider an easy example. Suppose Jones approaches Smith with a gun and demands his wallet. Without hesitation or deliberation Smith immediately pulls out his wallet and hands it to Jones. Now, suppose Jones approaches Bob with a gun and demands his wallet. Bob without hesitation or deliberation engages Jones and successfully disarms him. The reactions of Smith and Bob were caused by antecedent conditions. Perhaps Bob was so well trained in self defense that his response to engage was instinctive or more likely his genetic disposition is such that he defaults towards fight rather than flight, whereas Smith’s genetic disposition defaults to flight.
Human action is still determined by antecedent conditions even when we add deliberation to the mix. Suppose Jones approaches Smith and asks him for five dollars. Smith remembers that he has five dollars and deliberates whether he should give it to Smith. He then decides to hand it over. It might be said that his act of giving was a choice because he deliberated about what to do and ultimately decided to give. However, this simply adds one more cause. Smith’s genetic disposition along with all previous social environments and experiences shaped his deliberation to be what it was. |

Moglen asserts that smokers are not blameworthy because they did not choose to smoke. Further, the businessmen in charge of Macy’s, Walmart, and their corporate competitors are nothing short of thieves. They create antecedent conditions by appealing to our emotions and our desire to feel as though we are a part of something meaningful. Accordingly, our purchases are compulsions rather than choices.
It is not clear why Professor Moglen applies the principles of determinism to consumers and not to businessman, but it is certainly true that he does. This must be the case because he ascribes moral blame to businessmen and moral blame cannot be ascribed to an agent acting compulsively. Indeed, this is why he renders smokers and consumers blameless. This position of applying determinism to some people and not to others, in addition to creating a large metaphysical conundrum, ignores the fact that businessmen must be acting compulsively just as consumers are; or in the very least that the same kind of story concocted to render consumers blameless can also be applied to businessmen in order to exculpate them from blame. |

For this would entail that there are super humans unencumbered by causality. |

- It would imply, at a maximum, a theory of blameworthiness inconsistent with some fundamental facts about human beings. That would be pretty much the same as every other theory of blameworthiness I know of. But we would be having a dispute at any event about whether to blame someone, not a dispute about the degree of determination as against choice in the construction of a human life path.
- As I've indicated, I think the argument here is based on a fallacy. I think the right next step is to figure out not what the complaint is with me, but what the idea is that you have to present as your own. That might conceivably have something to do with this dichotomy between determination and choice (which isn't my categorization, you know—I've pointed out that we are social animals living in societies whose roots are older than language and consciousness, and that what we call individual choice is often mostly or entirely something else. I would have said the something else is social action, which you are calling determinism for reasons that I think would bear some serious examination.

Professor Moglen has done what many do: he inconsistently applied a theory of blameworthiness. So what? I concede this is not a prodigious error, but given the complexities of using determinism as a basis for blame, when in fact it is the quintessential basis of no blame for anyone, I think it should be abandoned. A better approach would be to lay out values that most of us agree on, and from those values determine whether the tobacco hustler and the corporate peddler can be blamed for acting contrary to them. |
